BY ENTERING THE SWEEPSTAKES, YOU MUST AGREE TO THESE OFFICIAL RULES, WHICH CREATE A CONTRACT SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, SUCH CONTRACT INCLUDES GRANTS OF RIGHTS AND INDEMNITIES TO SPONSOR FROM YOU AND MANDATORY ARBITRATION OF DISPUTES AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

1. Eligibility
The Kura Sushi "Fly to Japan" Sweepstakes (the “Sweepstakes”) is open to legal residents of the United States, requiring a visit a Kura Sushi USA location to participate, who are at least the age of majority in their state of residence (which is eighteen (18) years old in most states but is nineteen (19) years old in Alabama and Nebraska, and twenty-one (21) years old in Mississippi) at the time of entry. Employees, officers, directors, and agents of Kura Sushi USA, Inc. (“Sponsor”), its parent companies, affiliates, subsidiaries, advertising and promotion agencies (collectively, “Sweepstakes Entities”), and their immediate family members (spouses, parents, children, siblings, and their respective spouses) and household members are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

2. Sweepstakes Period
The Sweepstakes begins at 11:00 AM PST on October 23, 2024, and ends at 10:00 PM PST on October 30, 2024, subject to extension by Sponsor in its sole and absolute discretion (the “Sweepstakes Period”). All entries must be received by the Sponsor during the Sweepstakes Period to be eligible for the prize.

3. How to Enter
By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with these “Official Rules” and the decisions of Sponsor, including the interpretation of these Official Rules and its exercise of discretion, which will be final and binding in all respects. There are two methods of entry for this Sweepstakes.

Method 1: Entry with Purchase and Official Entry Form
To enter, make a purchase of at least $65 (excluding taxes, tips, and fees) at any participating Kura Sushi location during the Sweepstakes Period. For each eligible purchase, you will receive one (1) pair of Kura Sushi 15 Year Anniversary commemorative chopsticks with a serial number (which serves as your entry code, “Entry Code”) and QR code on the paper sleeve. Scan the QR code with the camera of an internet enabled device to visit the registration website, [https://form.jotform.com/242560633614049] (the “Website”) or visit the Website directly. The Website will contain a description of the Sweepstakes and the “Official Entry Form.” In the alternative, the entrant may request a paper version of the Official Entry Form in person, from a participating Kura Sushi location, and submit the completed form to the Kura Sushi location during the Sweepstakes Period.

Each entrant will be asked to submit an Official Entry Form, which may include, among other things, entrant’s full name, address (no P.O. Boxes permitted), email address, date of birth, Kura Sushi USA location visited, and Entry Code. Entrant must complete and submit the entry form with all required information for the entry to be eligible. Entrants agree to check the Website prior to the end of the Entry Period for any changes, and to ensure that there is no need to reenter. Information collected from entrant via the Official Entry Form will only be used for direct marketing purposes if the entrant consents to use in such manner. Any requested opt-in consent is not required to enter the Sweepstakes and will not increase your chances of winning.

Chopsticks are available while supplies last, and once chopsticks are no longer available, you will no longer receive an entry via this method. Limit: One (1) entry per household.

Method 2: Mail-In Entry (No Purchase Necessary)
To enter without making a purchase, handwrite your full name, complete mailing address, email address, and phone number on a 3”x 5” card and mail it with proper postage to:

Mail-in entries must be postmarked by October 30, 2024, and received by November 6, 2024, to be eligible. Limit: One (1) entry per household. Limit: One (1) entry per person and household, regardless of the method of entry. Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact information or otherwise may be disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Sponsor's sole and absolute discretion. All materials submitted become the property of Sponsor and will not be returned. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor's satisfaction, the affected entry will be deemed ineligible. For purposes of this Sweepstakes, an on-line entry is “received” when the Website’s servers record the entry information. Proof of sending (such as an automated computer receipt confirming entry or “thanks for entering” message) does not constitute proof of actual receipt of an entry for purposes of this Sweepstakes. The Website's database clock will be the official time keeper for this Sweepstakes. Assurance of delivery of entries is the sole responsibility of the entrant. Illegible and/or incomplete entries and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of Sponsor may be disqualified. Sponsor may run multiple campaigns, contests, sweepstakes or other promotions simultaneously. Entry into one (1) campaign, contest or sweepstakes does not constitute entry into any other.

4. Prize and Value
Sponsor will be awarding one (1) “Grand Prize” consisting of: two (2) roundtrip economy/coach airline tickets (one (1) for the winner and one (1) companion) via a Sponsor-selected air carrier(s) from a major commercial airport in the United States to a major commercial airport in Japan, both airports selected by Sponsor in its sole and absolute discretion. The total ARV for the Grand Prize is up to $4,999 (USD). Actual retail value of Grand Prize may vary depending on point of departure, travel dates and fare/rate fluctuations, but shall not exceed the stated ARV. If the actual value of the prize is less than the stated ARV, the difference will not be awarded to the Grand Prize winner. All travel arrangements must be made through the Sponsor or Sponsor's designee. Certain restrictions and black out dates may apply. The winner of the Grand Prize must travel as and when designated by Sponsor or the Trip Prize may be forfeited and an alternate randomly selected winner chosen.

Prizes are non-transferable, with no cash redemptions, equivalents or substitutions except at Sponsor's sole and absolute discretion. All prize details not specified in these Official Rules will be determined in Sponsor's sole and absolute discretion. Prize details and availability are subject to change and prize provider's rules and restrictions, and in the event that Sponsor is unable to provide the winner with their prize, the Sponsor may elect, to provide winners with the approximate value of such item in cash or award an alternate prize of comparable or greater value. In the event a prize winner (and/or his or her companion(s) (if applicable)) engage in behavior that (as determined by Sponsor or any prize provider in its or their sole and absolute discretion) is obnoxious, inappropriate, or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early. All prizes are awarded "AS IS" and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Prize winner(s) will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prize(s) they receive, regardless of whether it, in whole or in part, are used. The approximate retail value (“ARV”) of the prize(s) is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winner(s) may be required to provide Sponsor with a valid social security number or tax identification number before the prize will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of winner(s) for the actual value of the prize(s) received. Unclaimed prize(s) will be forfeited. The Approximate Retail Value (ARV) of the prize is $4,999.

The Grand Prize winner and his or her travel companion must travel together on the same itinerary and possess all required travel documents and permissions, including visas and valid passports, if and as applicable. It is the responsibility of the Grand Prize winner and their companion(s) to provide proper documentation (including government issued picture identification, passport, and visa (if required)). All aspects of the travel portions of the Grand Prize must be conducted on such dates as determined by Sponsor in its sole and absolute discretion. The dates of departure and return are subject to change at Sponsor’s sole and absolute discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Travel must be booked at least two (2) weeks prior to travel and all travel must be completed by October 31, 2025. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Sponsor reserves the right to structure travel route in their sole and absolute discretion. The Grand Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules. The round trip air transportation element for the Grand Prize begins and ends at the point of departure. The Grand Prize is subject to seat availability, as well as Sponsor’s terms and conditions generally applicable thereto. If in the judgment of Sponsor air travel is not required due to winner's proximity to Grand Prize location, ground transportation will be substituted for roundtrip air travel at Sponsor's sole and absolute discretion. The difference in value will not be awarded to the Grand Prize winner.

Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, transportation companies, prize providers or any other persons providing any Grand Prize-related services or accommodations. Sponsor is not liable for any missed prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. No refund or compensation will be made in the event of the cancellation or delay of any transportation or other prize element except at the sole and absolute discretion of Sponsor. Additional prize award details and travel information to be provided to the Grand Prize winner at the time of Grand Prize notification. Grand Prize winner and companion(s) are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Companion(s) of Grand Prize winner must be at least the age of majority in their state of residence (which is eighteen (18) in most states but is nineteen (19) in Alabama and Nebraska and twenty-one (21) in Mississippi) as of the date of departure. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Once a travel companion is selected, he/she may not be substituted, except in Sponsor's sole and absolute discretion. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by Sponsor’s transportation carrier(s) of choice. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged. All expenses not specifically mentioned herein, are not included as part of any Grand Prize package, and are solely the Grand Prize winner’s responsibility, including, but not limited to: hotel fees and taxes, additional ground transportation at the Grand Prize winner’s destination(s), travel insurance, room service, bag check fees, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, tips, gratuities and service charges. Transportation carrier regulations and conditions apply. Travel is subject to availability, and any changes made to either of these will be at the expense of the Grand Prize winner. If the Grand Prize winner becomes disabled or cannot otherwise fully enjoy the Grand Prize travel package due to illness, Sponsor shall have the option of: (a) being relieved of liability for fulfillment of the Grand Prize award; or (b) at Sponsor's sole and absolute discretion, extending the period during which the Grand Prize may be awarded for a period equal to the duration of the Grand Prize winner's disability or illness, in which case certain prize components may not be available. The Grand Prize winner must prove such disability by a doctor's certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and Grand Prize winner at Sponsor's expense.

5. Odds of Winning
The odds of winning depend on the total number of eligible entries received during the Sweepstakes Period.

6. Winner Selection, Notification, and Eligibility Verification
The Grand Prize winner will be selected in a random drawing on or about November 12, 2024, from among all eligible entries received during the Sweepstakes Period in accordance with these Official Rules. The potential winner will be notified via email and/or phone and/or mail (as selected by Sponsor), using the information provided during entry, in a commercially reasonable time after the drawing. Sponsor will have complete discretion over interpretation of the Official Rules, of administration of the Sweepstakes, and of selection of the winner(s). Decisions of the Sponsor as to the selection of the winner(s) will be final. The Sweepstake Entities are not responsible for false, incorrect, changed, incomplete or illegible contact information. Notification is deemed to have occurred immediately upon sending of an e-mail, placing of a phone call, or three (3) days after mailing.

The potential winner and the potential winner’s travel companion must respond to the notification within seven (7) days and may be required to sign and return an Affidavit of Eligibility, a release of liability, prize acceptance agreement, and a publicity release (where permitted by law) (collectively, the Affidavit”), and an IRS 1099 form for tax reporting purposes. The Sponsor reserves the right to verify the eligibility of the potential winner, including, but not limited to, age, residency, and employment status before awarding the prize. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. The Sweepstake Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winners.

If the potential winner cannot be contacted, fails to respond within the required time frame, fails to sign and return the Affidavit, or fails to comply with these Official Rules, the prize may be forfeited, and an alternate winner selected, all at Sponsor’s sole discretion.

7. General Conditions
By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, technical failure, or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, award the prize from among all non-suspect, eligible entries received up to the time of such action.

In the event Sponsor is prevented from continuing with the Sweepstakes by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Sweepstakes by any party, or any federal state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a "Force Majeure" event or occurrence) Sponsor shall have the right to modify, suspend or terminate the Sweepstakes or prize. Sponsor additionally reserves the right, in its sole and absolute discretion: (1) to modify, suspend or terminate the Sweepstakes should causes beyond Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Sweepstakes; or (2) to disqualify any entrant found to be, or suspected of: (a) tampering with the entry process or the operation of the Sweepstakes; (b) acting in violation of these Official Rules; or (c) acting in an un-sportsmanlike manner.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Sweepstakes Entities in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.

The invalidity or unenforceability of any provision of these Official Rules or the Affidavit will not affect the validity or enforceability of any other provision. If any provision of the Official Rules or the Affidavit is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as “may” are used in these Official Rules, Sponsor has sole and absolute discretion. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on the Website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.

8. Liability Release
By entering, entrants agree to release, discharge, and hold harmless Sponsor and Sweepstake Entities, and all of their respective officers, directors, employees, representatives, and agents from and against any and all claims, costs, liabilities, losses, damages, or injuries resulting from participation in the Sweepstakes and/or related to any prize (including, without limitation, losses, damages or injuries to entrant's or any other person’s equipment or other property, or to their persons, related to participation in the Sweepstakes; or arising out of any violation of rights of publicity or privacy, or claims of defamation or portrayal in a false light; or based on any claim of infringement of intellectual property; or from any typographical, human or other error in the printing, offering, selection, operation or announcement of any Sweepstakes activity and/or prize). Without limiting the generality of the foregoing, entrants agree that Sweepstakes Entities: (A) have neither made nor will be in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, in connection with the Sweepstakes and/or with respect to prizes, including, without limitation, to any prize’s quality or fitness for a particular purpose; (B) maintain no control over the personnel, equipment or operation of any air, water or surface carrier, ship line, bus or limousine company, transportation company, hotel, manufacturer or other person or entity furnishing services, products or accommodations (“Suppliers”) as a part of the prizes provided in connection with the Sweepstakes; and (C) will not be responsible or liable for any injury, damage, loss, expense, accident, delay, inconvenience or other irregularity that may be caused or contributed to: (1) by the wrongful, negligent or unauthorized act or omission on the part of the Suppliers or any of their agents, servants, employees or independent contractors, (2) by any defect in or failure of any vehicle, equipment, instrumentality, service or product that is owned, operated, furnished or otherwise used by any of those Suppliers, (3) by the wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Sweepstakes Entities, and (4) by any cause, condition or event whatsoever beyond the control of the Sweepstakes Entities. Entrants agree and that the Sweepstakes Entities shall have no responsibility or liability for discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by Sponsor; interruption or inability to access the Website or Sponsor or affiliated entities’ respective websites, or any online service via the Internet due to hardware or software compatibility problems; any damage to participant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; and/or any other errors or malfunctions, even if caused by the negligence of the Sweepstakes Entities. Each entrant further agrees to indemnify and hold harmless Sweepstakes Entities from and against any and all liability resulting or arising from the Sweepstakes and to release all rights to bring any claim, action or proceeding against Sweepstakes Entities and hereby acknowledge that Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a Supplier that may be sent along with a prize. Sponsor is not responsible for the actions of entrants in connection with the Sweepstakes, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Sweepstakes. Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Entrants acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED SIXTY-FIVE DOLLARS ($65.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED SIXTY-FIVE DOLLARS ($65.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.

9. Publicity Release
Except where prohibited by law, participation in the Sweepstakes constitutes the winner’s irrevocable consent to Sweepstake Entities and Sweepstake Entities’ licensees’ use of the winner’s name, likeness, photograph, voice, opinions, biographical information, and city and state of residence for promotional purposes in connection with the Sweepstakes, in any media by all manners (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration except for the awarding of the prize(s) to the winner(s). Winner(s) acknowledge that Sweepstakes Entities are relying on the irrevocable, unconditional and perpetual nature of the grants of rights and releases herein (including, without limitation, regarding rights of publicity), and any interference by winner(s) therewith would cause Sweepstakes Entities, and its successors, licensees and assigns, irreparable (not compensable by money damages alone) and excessive damages and would be manifestly unfounded, such that Sweepstakes Entities shall be entitled to equitable and injunctive relief (with no obligation to post bind or surety or establish likelihood of success) in addition to remedies at law. Entrants agree not to issue any publicity concerning the Sweepstakes Entities, unless agreed to in writing by an executive of the Sweepstake Entities.

10. Taxes
All federal, state, and local taxes associated with the receipt or use of the prize are the sole responsibility of the winner. Sponsor will issue a 1099 tax form to the winner for the ARV of the prize as required by law.

11. Privacy
Any personal information collected from entrants will be used only for the administration of the Sweepstakes and in accordance with Sponsor’s privacy policy, which can be found at https://kurasushi.com/privacy-policy.

12. Dispute Resolution
The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in Los Angeles County, California and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a "Demand for Arbitration", then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Chicago, IL, New York City, NY, Los Angeles, CA, Atlanta, GA or Dallas, TX (whichever is closest to entrant's residence); provided, however, if none of these locations are convenient for the hearing, the parties may mutually agree on an alternative location. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in Los Angeles County, California. Sponsor agrees to pay the administrative and arbitrator's fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
